PlayerLink Member Agreement
  1. For purpose of this agreement, "Player" shall mean any person who establishes authorized access to PlayerLink's online database and uses any of the PlayerLink services; and "PlayerLink" shall mean playerlink.com, a Limited Liability Company, with offices in Maui, HI and Santa Cruz, CA.
  2. The Player shall be responsible for, and assumes all liability associated with, any material made available though the service, including but not limited to liability for claims of infringement of intellectual property rights and defamation. The Player shall not post or, transmit through the service
    • Any material which violates or infringes in any way upon the rights of others, which is obscene, unlawful, abusive, vulgar, defamatory, profane, sexually explicit, racist, hateful, threatening or otherwise objectionable or which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law, OR,
    • Any copyrighted material, without the express written consent of the owner thereof, OR
    • Any advertising or any solicitation with respect to products or services without the express prior written consent of PlayerLink.
  3. The player agrees that the use of the service is at the player's sole risk, and understands PlayerLink makes no warranties or guarantees. Neither playerlink, nor any of their respective employees, agents or licensors warrant that the service will be uninterrupted or error-free; nor do playerlink or any of the foregoing persons or entities make any warranty as to the accuracy, reliability or content of any information, products or services provided through the service or the results to be obtained from use of the service. The player's sole and exclusive remedy and PlayerLink sole and exclusive obligation for any damages caused or allegedly caused by any defect in the service shall be to terminate the service.
  4. PlayerLink reserves the right, at any time, to modify the terms of this Agreement or modify the service, including eliminating any content or feature of the Service, or limiting the amount of use permitted by the Player. Players will be given notice of the modifications via email to their registered address. Any use of the service under a Player's Account after such notice shall be deemed to constitute acceptance by the Player of the modifications.
  5. PlayerLink may send notices to Player, at PlayerLink's option, by electronic mail. Notices by Players to PlayerLink must be provided by electronic mail, sent to office@playerlink.com. Notices provided by a Player will not change the terms of this Agreement unless PlayerLink expressly accepts a modification in writing.
  6. Either PlayerLink or the Player may terminate this Agreement and the Player's Account at any time, with or without cause. PlayerLink may suspend or terminate Player's Account, without notice, in the event of any breach by the Player of this Agreement or for other conduct by the Player which PlayerLink, in its sole discretion, considers to be unacceptable. Suspension or termination of a Player's Account means that the service will no longer be accessible to the Player. PlayerLink shall not be responsible for any consequences of such lack of access. The provisions of the Agreement will survive the termination of the Player's Account, whether by PlayerLink or the Player.
  7. Under PlayerLink's privacy policy, we may disclose to third parties certain aggregate information contained in Player's registration application, but we will not disclose your name, address, email address, or telephone number without your prior written consent, except as required by law.   8. The handicap calculated by the service is not an official USGA handicap. The service is for entertainment purposes only, and does not nor is intended to provide or replace an official USGA handicap index USGA, USGA Handicap, Slope, USGA Course Rating, Handicap Index are registered trademarks of the United States Golf Association.
  9. You have the right to withdraw your consent any time at no cost to you. However, if you do, then you will no longer be eligible to enter the game. If you wish to withdraw your consent, you must notify PlayerLink by Email: withdraw.playerlink.com
  10. In order to insure that we are able to provide you with important notices and other information from time to time, you must update us with any changes in your email address. The form to change your email address is available under player information page on our site.
  11. GAME OF SKILL; WINNER SELECTION. THIS IS A GAME OF SKILL. WINNERS WILL BE DETERMINED BY THE OBJECTIVE CRITERIA SET FORTH. From all eligible entries received, the winners will be determined based on their ability to use their skill and knowledge of their relevant golfing ability and their choice of partners they choose to accumulate the most points.
  12. GAMBLING PROHIBITION. This game may not be used in connection with any form of gambling.
  13. DISCLAIMER: CONTENT. PlayerLink and any of its parent companies, subsidiaries or affiliates will not be responsible for: (a) any late, lost, garbled, misdirected, incomplete, or damaged entries; (b) any Game disruptions, injuries, losses or damages caused by events beyond the control of PlayerLink; or (c) any printing or typographical errors in any materials associated with the game. By entering the Game, the entrant consents to placement on a mailing list for promotional and other materials, (unless the "opt out" option is chosen pursuant to PlayerLink.com's privacy policy) and grants to PlayerLink the right to use and publish the entrant's proper name, state or province of residence, score, and ranking online and in any other media in connection with the game, unless prohibited by law. Void where prohibited.
  14. ENTRY. The deadline to join the Pro-Am Tournaments Game and select golfers is the day before the tournament starts by 12:01 AM PST.
  15. PRIZES will be awarded to the golf course or golf shop of the player's choice.NOTIFICATION. Winners will be notified by e-mail or regular mail within seven (7) days after the date the winning scores are determined each week of the Pro-Am Tournaments. The winners will be issued a gift certificate to be redeemed at the golf course or golf shop they have requested. If the full amount of the gift certificate is not used a credit will be issued as customary from the establishment where it is being redeemed. NO cash will be returned. There is no purchase necessary to play in the Pro-Am tournaments. The player may mail in his or her entry to PlayerLink Tournament Entry P.O. Box 71 Boulder Creek California, 95006. This entry must contain a copy of the scorecard signed by the Golf Professional of the course where the round was played and accompanied by a copy of the player's handicap card. The entry must be received by 12:01 AM PST two days prior to the tournament, in the same week of tournament. Please select your three professionals to be on your team. Please supply a self addressed stamped envelope. Player is limited to one entry per event.16.
  16. . CONDUCT. The Official Rules will be posted at the tournament web site throughout the tournaments term. PlayerLink reserves the right as its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Tournaments or web site; to be acting in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person. PlayerLink reserves the right to lock out an entrant whose eligibility is in question or who has been disqualified or is otherwise ineligible to enter the Game.

    CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY ALTER OR DAMAGE ANY WEB SITE OR UNDERMINE THE LEGIMATE OPERATION OF THE GAME IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE PLAYERLINK RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW.18. LIMITATIONS OF LIABILITY. PlayerLink is not responsible for any incorrect or inaccurate information, whether caused by web site users or by any of the equipment or programming associated with or utilized in these tournaments or by any technical or human error, which may occur in the processing of submissions in the Play of these tournaments. PlayerLink assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communication line failure, theft of or destruction or unauthorized access to, or alteration of entries. PlayerLink is not responsible for any problems or technical malfunction of any telephone network of lines, computer online systems, servers or providers, computer equipment, software failure or e-mail or entrants due to or resulting from technical problems or traffic congestion on the Internet or at any web site or combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in these tournaments. If, for any reason, the tournament is not capable of running as planned due to: (a) infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, or any other causes beyond the control of PlayerLink, which corrupt or affect the administration, security, fairness, integrity or proper conduct of these tournaments; or (b) earthquake, flood, fire, storm or other natural disaster, act of God, labor controversy or threat thereof, civil disturbance or commotion, disruption of the public markets, war or armed conflict (whether or not officially declared) PlayerLink reserves the right at its sole discretion to cancel, terminate, or suspend these tournaments and in such an event, to select winner by random drawing from all valid entries received up to the time of cancellation, termination or suspension.20. SEVERABILITY. In the event that any provision of the Official Rules is found invalid or unenforceable pursuant to judicial decree or decision, the remainder of the Official Rules shall remain valid and enforceable according to its terms. The parties intend that the provisions of the Official Rules enforced to the fullest extent permitted by applicable law. Accordingly, the parties agree that if any provisions deemed not enforceable, they shall be deemed modified to the extent necessary to make them enforceable.
